Liability for content
The content of these pages has been created with the utmost care. However, I cannot guarantee that it is accurate, complete or up to date. As a service provider, I am responsible for my own content on these pages under general law. Pursuant to Articles 4 to 8 of the EU Digital Services Act (Regulation (EU) 2022/2065) in conjunction with Section 7 of the German Digital Services Act (DDG), I am not obliged to monitor third-party information transmitted or stored, or to investigate circumstances indicating illegal activity. Obligations to remove or block the use of information under general law remain unaffected. Liability in this respect is only possible from the time I become aware of a specific infringement. As soon as I become aware of such an infringement, I will remove the content concerned immediately.

Liability for links
This website contains links to external websites of third parties, over whose content I have no influence. The respective provider or operator is always responsible for the content of linked pages. The linked pages were checked for possible legal violations at the time of linking; no illegal content was apparent. Permanent monitoring of linked pages is not reasonable without concrete indications of an infringement. As soon as I become aware of an infringement, I will remove the link concerned immediately.

Privacy Policy

1. Controller

The controller responsible for processing personal data on this website within the meaning of the EU General Data Protection Regulation (GDPR) is:

Michael Emperiom
Friedensstraße 25
19306 Brenz
Germany
Phone: +49 174 9719021
Email: michael@emperiom.com

This privacy policy applies to the website www.emperiom.com. It explains which personal data is processed when you visit it, for what purposes and on which legal basis, and which rights you have. I am not legally required to appoint a data protection officer and have not done so.

2. General information on data processing

I process personal data only to the extent necessary to provide a working website, its content and the newsletter, and to answer your enquiries.

Legal bases. Depending on the purpose, processing is based on:

– Art. 6(1)(a) GDPR – your consent (e.g. newsletter subscription)
– Art. 6(1)(b) GDPR – performance of a contract or steps prior to entering into a contract (e.g. enquiries about commissions)
– Art. 6(1)(c) GDPR – compliance with a legal obligation (e.g. retention duties under tax and commercial law)
– Art. 6(1)(f) GDPR – my legitimate interests (e.g. secure and stable operation of the website, anonymous visitor statistics, answering general enquiries)

Storage period. I delete personal data as soon as the purpose of processing no longer applies, you withdraw your consent or you validly object, unless statutory retention periods require me to keep it. Retention periods under German tax and commercial law generally range from six to ten years.

Recipients. I do not sell or rent personal data. Data is passed on only to service providers who process it on my behalf and under my instructions (Art. 28 GDPR), such as my hosting provider, or where I am legally obliged to do so.

Transfers outside the EU. I do not transfer personal data to countries outside the European Union or the European Economic Area.

No obligation, no automated decisions. You are not obliged to provide personal data. Without it, however, I cannot send you the newsletter or reply to your message. I do not use automated decision-making or profiling.

3. Hosting and server log files

This website and my email inbox are hosted by:

prosem – Dipl.-Ing. Christian Boß
Elsbeeker Straße 44
42553 Velbert
Germany

The provider processes data only on my behalf and in accordance with my instructions. I have concluded a data processing agreement with it pursuant to Art. 28 GDPR.

Each time you visit the website, the server automatically records the following information in log files:

– IP address of the requesting device
– date and time of the request
– page or file requested
– referring website (referrer URL)
– browser type and version, operating system
– amount of data transferred and HTTP status code

This data is needed to deliver the website to your browser, to ensure the security and stability of the server and to detect errors or attacks. It is not combined with other data sources. The legal basis is Art. 6(1)(f) GDPR; my legitimate interest lies in the secure and error-free operation of the website. Log files are deleted as soon as they are no longer needed for these purposes, unless they must be kept longer to investigate a specific security incident.

4. Cookies

This website does not use cookies for tracking, advertising or marketing purposes. Visitor statistics work without cookies (see section 7).

Where the website sets technically necessary cookies, for example to keep it working properly or for the site administrator’s login, this is permitted without consent under § 25(2) No. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG). Any personal data involved is processed on the basis of Art. 6(1)(f) GDPR; my legitimate interest lies in providing a functioning website.

You can configure your browser to inform you about cookies, to accept them only in individual cases or to block them altogether. Blocking necessary cookies may limit some functions of the website.

5. Contacting me by email or phone

If you contact me by email or phone, I process the data you provide (e.g. your name, email address, phone number and the content of your message) solely to handle your enquiry and any follow-up questions.

If your enquiry relates to a commission or another contract, the legal basis is Art. 6(1)(b) GDPR. For all other enquiries it is Art. 6(1)(f) GDPR; my legitimate interest lies in responding to messages addressed to me.

I delete this data once your enquiry has been fully dealt with, unless statutory retention obligations apply, for example for business correspondence. Emails are processed on the mail servers of my hosting provider (section 3).

6. Newsletter

If you subscribe to my newsletter, I use your email address and any further information you voluntarily provide (e.g. your name) to send you news about my music, releases, projects and events.

The newsletter is managed with a WordPress plugin on this website. Subscriber data is stored in the website’s database on the servers of my hosting provider (section 3) and is not passed on to third parties.

Double opt-in. After signing up, you receive an email asking you to confirm your subscription. You are only added to the mailing list once you click the confirmation link. To be able to prove that you subscribed, I store the time of sign-up and confirmation and the IP address used.

Legal basis. The newsletter is sent on the basis of your consent (Art. 6(1)(a) GDPR). Logging the sign-up is based on Art. 6(1)(f) GDPR; my legitimate interest lies in being able to demonstrate your consent.

Unsubscribing. You can withdraw your consent at any time with effect for the future, using the unsubscribe link in every newsletter or by sending an email to michael@emperiom.com. The lawfulness of processing carried out before your withdrawal remains unaffected. After you unsubscribe, I delete your data from the mailing list. I may keep your email address in a blocklist so that you do not receive any further newsletters (Art. 6(1)(f) GDPR).

7. Visitor statistics, fonts and external links

WP Statistics. To understand how this website is used, I use the WordPress plugin WP Statistics. It runs entirely on my own website: all statistics are stored in the website’s database on my hosting provider’s servers and are not transferred to the plugin developer or any other third party. The plugin works without cookies. IP addresses are anonymised before storage, so no conclusions can be drawn about individual visitors. It records, for example, the pages visited, time of visit, referring website, browser, operating system, device type and approximate country. The legal basis is Art. 6(1)(f) GDPR; my legitimate interest lies in an anonymous statistical evaluation of visitor numbers to improve the website. Statistics data is deleted automatically after 12 months.

Fonts. All fonts used on this website are stored on my own server and loaded from there. No connection to external font services such as Google Fonts is established.

Shop and social media links. This website links to my shop (SumUp) and to my profiles on Spotify, Apple Music, YouTube, Instagram and TikTok. These are plain links, not embedded content: no data is transferred to these providers while you browse this website. Only when you click a link and visit the respective platform does its operator process your data, under its own responsibility and privacy policy.

8. Your rights

You have the following rights regarding your personal data. To exercise them, simply email michael@emperiom.com; this is free of charge.

– Access to the data I hold about you (Art. 15 GDPR)
– Rectification of inaccurate or incomplete data (Art. 16 GDPR)
– Erasure of your data (Art. 17 GDPR)
– Restriction of processing (Art. 18 GDPR)
– Data portability in a structured, commonly used format (Art. 20 GDPR)
– Withdrawal of consent at any time with effect for the future (Art. 7(3) GDPR)

Right to object (Art. 21 GDPR). Where I process your data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you have the right to object at any time on grounds relating to your particular situation. I will then stop processing your data unless I can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.

Right to lodge a complaint. You have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your habitual residence, place of work or the place of the alleged infringement. The authority responsible for me is:

Der Landesbeauftragte für Datenschutz und Informationsfreiheit Mecklenburg-Vorpommern
Schloss Schwerin, Lennéstraße 1
19053 Schwerin, Germany
www.datenschutz-mv.de

9. Data security and changes to this policy

This website uses SSL/TLS encryption for the secure transmission of data. You can recognise an encrypted connection by “https://” in your browser’s address bar and the lock symbol.

I may update this privacy policy when the website or the legal requirements change. The version published on this page applies.
